These Terms & Conditions apply to your use of the Love4Curls website and to purchases made through www.love4curls.com.
By using our website or placing an order, you agree to these Terms & Conditions.
1. About Love4Curls
Love4Curls is an Australian haircare business operated as a partnership.
In these Terms & Conditions, “Love4Curls”, “we”, “us” and “our” refer to Love4Curls and “you” and “your” refer to the person accessing our website or purchasing our products.
2. Using Our Website
You agree to use our website only for lawful purposes.
You must not:
- use our website for fraudulent or unlawful purposes;
- attempt to gain unauthorised access to our website or systems;
- interfere with the security or operation of our website;
- reproduce or commercially exploit our website content without permission; or
- provide false or misleading information when placing an order.
We reserve the right to refuse or cancel an order where we reasonably believe fraudulent, unlawful or abusive activity has occurred.
3. Our Products
Love4Curls products are designed specifically with rich, tight hair textures in mind, including Type 4 hair.
We take care when describing and photographing our products. However, product appearance, packaging and colour may vary slightly from images displayed on different screens.
We may update product formulations, packaging or ingredients from time to time. The most current ingredient information should always be checked on the product packaging or relevant product page before use.
4. Product Suitability & Individual Results
Hair and skin can respond differently from person to person.
Although Love4Curls products are developed with particular hair textures and needs in mind, we cannot guarantee a particular result for every individual.
Our products are cosmetic haircare products and are not intended to diagnose, treat, cure or prevent medical conditions.
If you have allergies, sensitivities or concerns about a particular ingredient, you should review the ingredient list before purchasing or using a product.
If you are unsure whether a product is suitable for you, please contact us through our Let’s Talk page before using the product.
5. Patch Testing
We recommend patch testing a new product before full use, particularly if you have sensitive skin or have previously experienced reactions to cosmetic products.
If irritation or an adverse reaction occurs, discontinue use and seek appropriate professional advice where necessary.
6. Orders
When you place an order through our website, you are offering to purchase the products selected during checkout.
An order confirmation confirms that we have received your order. We reserve the right to cancel an order where:
- a product is unavailable;
- there is an obvious pricing or product description error;
- payment cannot be processed; or
- we reasonably suspect fraudulent or unauthorised activity.
If an order is cancelled after payment has been received, we will arrange an appropriate refund.
7. Prices
All prices are displayed in Australian dollars (AUD) unless otherwise stated.
We may change our prices at any time. Price changes will not affect orders that have already been accepted.
From time to time, Love4Curls may offer promotions, discounts, gift cards or other special offers. Additional conditions may apply to individual promotions.
8. Payment
Payment is required at checkout using one of the payment methods made available on our website.
You confirm that you are authorised to use the payment method provided.
Payment information may be processed by third-party payment providers and is subject to their respective terms and privacy policies.
9. Shipping
Love4Curls currently ships within Australia only.
Orders are generally prepared for dispatch within up to 2 business days.
Orders are sent using Australia Post.
Delivery timeframes are estimates and may vary depending on your location, Australia Post delays, public holidays, peak periods, weather or other circumstances outside our reasonable control.
We do not currently offer international shipping.
10. Delivery Address
You are responsible for providing a complete and accurate delivery address.
If an order has been dispatched to an incorrect address supplied by you, additional costs may apply if the order needs to be redirected or resent.
11. Damaged, Missing or Incorrect Orders
If your order arrives damaged, leaking, incomplete or contains the wrong product, please contact us through our Let’s Talk page as soon as reasonably possible.
We may request photographs, your order number and other information necessary to investigate the issue.
We will assess the circumstances and provide an appropriate remedy where required under Australian Consumer Law.
12. Returns & Refunds
Love4Curls complies with applicable rights and remedies under the Australian Consumer Law.
If a product is faulty, unsafe, significantly different from its description or otherwise does not meet an applicable consumer guarantee, you may be entitled to a repair, replacement or refund as required by law.
Change-of-mind returns
Because Love4Curls products are personal-care products, we do not automatically accept returns simply because you have changed your mind.
However, we may consider a change-of-mind return on reasonable grounds, particularly where the product is unopened, unused and in its original condition.
Please contact us before returning any product.
Nothing in this section limits or excludes any rights you may have under the Australian Consumer Law.
13. Gift Cards
Love4Curls may offer gift cards from time to time.
Unless otherwise stated:
- gift cards may only be redeemed through the Love4Curls website;
- gift cards cannot be exchanged for cash;
- gift cards cannot be used to purchase another gift card;
- gift cards cannot be replaced if lost or stolen, except where required by law; and
- gift cards may be subject to an expiry period where permitted by law and clearly stated at the time of purchase.
Specific gift-card terms displayed at the time of purchase will apply.
14. Promotions & Discount Codes
Promotional codes and offers may have additional conditions.
Unless otherwise stated:
- promotional codes cannot be exchanged for cash;
- promotional codes cannot be applied retrospectively;
- promotional codes cannot be combined with other offers;
- promotional codes may have an expiry date; and
- certain products or bundles may be excluded.
Where specific promotional terms differ from these general Terms & Conditions, the specific promotional terms will apply.
15. Reviews & Customer Content
We love hearing from our customers.
If you submit a review, photograph, testimonial, video or other content to Love4Curls, you confirm that:
- you own the content or have permission to provide it;
- the content does not infringe another person’s rights;
- the content is not misleading, unlawful, abusive or defamatory; and
- any statements about your experience are genuine.
By submitting content, you give Love4Curls permission to reproduce, publish and display that content for Love4Curls marketing and promotional purposes, including on our website and social media channels.
We may remove content that is inappropriate, misleading, offensive or otherwise inconsistent with these Terms & Conditions.
16. Intellectual Property
All Love4Curls branding, logos, product names, photographs, graphics, text, videos, website content and other materials are owned by or licensed to Love4Curls unless otherwise stated.
You may not reproduce, modify, distribute or commercially exploit our content without our prior written permission.
17. Third-Party Services
Our website may contain links to or use services provided by third parties, including payment, delivery, analytics, social media and website service providers.
Third-party services are subject to their own terms and privacy policies.
Love4Curls is not responsible for the content, availability or practices of third-party websites.
18. Website Availability
We aim to keep our website available and functioning correctly but do not guarantee uninterrupted access or that the website will always be free from errors.
We may temporarily suspend the website for maintenance, security, updates or other operational reasons.
19. Liability
To the extent permitted by law, Love4Curls is not responsible for loss or damage resulting from misuse of our products, failure to follow product directions or failure to consider ingredient information before use.
Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies that cannot legally be excluded under Australian law.
